Easements
Under the 433 Agreement the drainage basins, pipes in and leading
from the road to the basins will have easements. All easements shall
have written legal descriptions dedicated to the drainage district.
All legal easements shall be prepared by the project surveyor and/or
engineer. All costs and recording fees for the on-site or off-site
easements will be paid by the Owner/Developer.
The minimum size of the underground pipe drainage easements will be
twenty (20) feet centered on the pipe. The minimum size of an open ditch
drainage easement shall be fifty (50) feet centered on the ditch.
The Drain Commissioner reserves the right to require a wider easement
if the situation warrants it.
No permanent building or trees will be permitted on easements or
rights-of-way without the express written permission of the Drain
Commissioner.
